The 309/100 Spouse Visa can be applied for if you are offshore. This is a two stage visa, which allows the spouse of an Australian permanent resident or citizen to move permanently to Australia. You make one application for both visa’s and you will usually be granted the 309 Provisional Visa, and then approximately 2 years later, your 100 permanent visa will be processed. In cases where you already have children or have been in a long term relationship, the department may process your 100 permament visa immediatley.
To be eligable for this visa you need to be married, or living in a defacto relationship to the exclusion of all others.
