Australia is a signatory to the Hague Abduction Convention.
In order for your children to be included in your application, you need to provide one of three pieces of evidence.
- A court order that specifically states that you may relocate the child internationally.
- Form 1229 signed bythe other parent, stating that they agree to the child being granted a visa. Download Form 1229
- A death certificate of the other parent.
Documents not in English need to be translated.
If there is no father listed on the child’s Birth Certificate, then you do not need to do anything, unless there is a parenting order for the other parent.
If you have been abandoned or are unable to contact the father, obtain a court order. The requirements in every country are different.
